Terms of use

1. Acceptance of Terms

By accessing or using MarketRebate.org (the “Site”) and its services, you agree to comply with and be bound by these Terms of Use (“Terms”). These Terms constitute a legal agreement between you and MarketRebate.org (referred to as “MarketRebate”, “we”, or “us”). If you do not agree with any part of these Terms, you must not use the Site or services. Please also review our Privacy Policy, which is incorporated by reference and governs our handling of your personal data.

2. Description of Services
MarketRebate.org provides a cashback and rebate service that allows members to earn cash rewards on qualifying purchases or transactions made through our partnered merchants and platforms. In essence, when you shop or engage in transactions via links or programs provided on our Site, we track those transactions through affiliate networks or partner integrations. When a purchase or transaction is confirmed by a partner and we receive a commission or rebate for it, we share a portion of that commission with you in the form of cashback. We may also offer related promotional services such as coupon codes, special deals, and referral rewards to help you save money. Membership is free – we do not charge users to join or use our basic cashback services.

Important: MarketRebate is not the merchant or seller of any products or services that you may purchase through partner links. All transactions you make are between you and the third-party merchant. MarketRebate simply facilitates your earning of rebates on those transactions. We make no warranties about the products or services provided by third-party merchants (see Section 13 and Section 15 for more details).

3. Membership & Eligibility

Account Registration: To use our cashback services, you must create an account with MarketRebate. You agree to provide truthful, accurate, and up-to-date information during registration (such as your name and a valid email address), and to update your information if it changes. Account registration is available to individuals 18 years of age or older who can form legally binding contracts. By joining, you confirm that you are at least 18 and are otherwise legally qualified to enter into this agreement.

One Account Per Person: Each individual is limited to a single MarketRebate account. Creating or controlling multiple accounts for one person is strictly prohibited. Likewise, accounts are for personal use only and should not be shared among multiple people. We reserve the right to refuse membership, or to suspend or terminate any account that we suspect is a duplicate or violates this one-account rule.

Geographic Availability: MarketRebate may be accessible worldwide, but certain features or merchants’ offers might only be available to users in specific regions. It is your responsibility to comply with any local laws regarding the use of our Site. We reserve the right to restrict access to the Site from any regions or jurisdictions if required (for example, due to legal restrictions or high risk of fraud). If you attempt to access the Site from a country or region where our services are not supported or allowed, your account may be blocked or terminated.

Email and Communications: By becoming a member, you agree that we may send you service-related communications (e.g. account statements, transaction confirmations, notifications about cashback status) via email or through the Site. You must verify your email address and maintain an active, deliverable email on file, as it is necessary for account verification and important updates. You can manage your preferences for non-essential communications (such as promotional newsletters) in your account settings, and you may opt out of marketing emails at any time. However, you cannot opt out of critical service or legal notices.

Right to Terminate or Refuse Service: MarketRebate reserves the right to refuse membership to anyone and to terminate any account at our discretion. Reasons might include (but are not limited to) violation of these Terms, engaging in fraudulent or abusive activities (see Section 6), or any behavior we deem unfair or harmful to our service or other users. We may also terminate accounts that are inactive or dormant as described in Section 9. In the event of termination of your account, you may forfeit any pending or unredeemed cashback rewards as described in Section 14.

4. User Responsibilities

By using the Site, you agree to the following responsibilities and conduct requirements:
Lawful Use: You will use MarketRebate and participate in our cashback program only for legitimate, lawful purposes. You agree to comply with all applicable laws and regulations while using our Site and services. You will not use the Site in any manner that could subject us to legal liability or that could be harmful to us or any other user.

Accurate Information: You commit to providing accurate information to MarketRebate, both during account registration and when using the service. This includes information needed for tracking transactions and for processing payments (such as your payment account details). Please note that personal information (e.g., name, email address, payment details) cannot be updated directly through your account settings. If any of your registered information needs to be changed, you must contact us at contact@marketrebate.org to request assistance. MarketRebate is not responsible for communication failures or payment issues arising from outdated or incorrect information you provide.

Account Integrity: You are responsible for maintaining the confidentiality of your login credentials (username and password) and for restricting access to your account. Do not share your password or allow others to log in to your account. You agree to immediately notify us if you suspect any unauthorized access to or use of your account. MarketRebate will not be liable for any loss or damage arising from someone else using your account due to your failure to keep your account secure.

Follow Cashback Instructions: You agree to follow any guidelines or instructions we provide for earning cashback. For example, this may include starting your shopping session through our Site, disabling ad-blockers or cookie blockers that may interfere with tracking, and not using unauthorized coupons if they invalidate cashback (see Section 7 for details on earning cashback). Following the proper procedures helps ensure that your purchases are tracked and your rewards are credited.

No Misuse of Service: You will not misuse the MarketRebate service or attempt to game the system. This includes refraining from any fraudulent behavior in attempts to earn cashback (such as placing fake orders, self-referring in violation of any referral terms, or repeatedly returning products after cashback is credited). You are responsible for any consequences of your own actions on the Site. If you abuse the service or violate these Terms, you may lose your rewards and access to the Site (see Sections 6 and 14).

5. Account Security

By using our Site, you acknowledge and agree to the following with regard to your account’s security:
Responsibility for Account Activity: You are solely responsible for all activities that occur under your MarketRebate account, whether or not you personally perform them. If someone else uses your login credentials to access the Site, we will presume it is you and you will be held accountable for their actions on the account. For this reason, never share your password and always safeguard access to your devices and account.

Password Safety: Choose a strong, unique password for your MarketRebate account and change it periodically. We recommend not using the same password for other accounts. MarketRebate will never ask you to reveal your password via email or phone. If you receive any suspicious communications asking for your account credentials, please inform us.

Unauthorized Access: If you suspect that your account has been compromised or accessed without your authorization (for example, if you notice unfamiliar transactions or your password no longer works), contact us immediately. You should also promptly change your password. We may ask you for certain information to verify your identity before assisting with securing your account.

Security Measures: We employ measures to protect accounts (such as encryption and fraud monitoring), but no system is foolproof. By using MarketRebate, you understand that you assume the risk of any unauthorized access that might occur despite our security efforts. We are not liable for any loss or damage resulting from unauthorized use of your account, except where it’s caused by our negligence or breach of duty.

6. Prohibited Activities

You agree that you will not engage in any of the following prohibited activities when using MarketRebate.org or its services:
Fraudulent or Illegal Conduct: Do not use the Site or services for any fraudulent or unlawful purpose. This includes attempting to earn cashback through deceit, such as using stolen payment methods, false identities, self-referrals in violation of program rules, or any form of transaction manipulation intended to generate rewards dishonestly. You also must not use MarketRebate to launder money or in connection with any illegal activity.

Interference with the Service: You must not attempt to interfere with the proper working of our Site. This means you will not deploy or use any device, software, script, or routine (including robots, crawlers, scrapers, or automated tools) to access, scrape, or index any portion of the Site. You also agree not to attempt to reverse-engineer, decrypt, decompile, or disassemble any of the software or underlying technology used to provide the Site. Any attempt to bypass any security measures or to test the vulnerability of our system is prohibited.

Virus or Malware Distribution: You shall not upload, transmit, or distribute to the Site any viruses, malware, worms, Trojan horses, corrupted files, or any other code that is malicious or technologically harmful. Introducing such harmful material or otherwise attempting to disrupt the integrity or performance of the Site or related systems is strictly forbidden.

Unauthorized Link Manipulation: You agree not to create, post, or share any unauthorized or modified links to MarketRebate or merchant sites that are designed to improperly obtain rewards. For example, you must not use URL masking/cloaking or publish your referral links in public forums in violation of our referral policies (if any). Additionally, you should not attempt to manually modify tracking URLs provided by MarketRebate in an effort to change tracking information. Any such tampering with links or tracking mechanisms is prohibited.

Impersonation and False Affiliations: Do not impersonate any person or entity, or falsely claim an affiliation with any company or service, including falsely representing yourself as an agent or employee of MarketRebate. You also may not use our Site to impersonate or harass any other user, or engage in any behavior that violates the legal rights (including rights of privacy and publicity) of others. Usernames that violate trademark rights or that are offensive may be changed or banned by us.

Spam and Unsolicited Promotions: If MarketRebate offers a referral program or any promotional sharing features, you must not abuse them by sending unsolicited bulk communications (spam) or misleading messages to people you do not know. Promotion of your referral links should be done in a personal and appropriate way, in compliance with any referral program terms. Using spam or excessive posting to advertise MarketRebate or referral opportunities (for example, posting your referral link repeatedly on forums or social media where it is unwelcome) is prohibited.

Any Other Harmful Activities: You agree not to engage in any other activity that, in our sole judgment, interferes with other users’ use and enjoyment of the Site, or that could harm or disparage MarketRebate’s reputation or goodwill. This includes refraining from any abusive language or hate speech in communications with our support or on any interactive features (if applicable).

Consequences: Engaging in any of the above prohibited activities constitutes a serious breach of these Terms. MarketRebate may take immediate action if you are found participating in prohibited conduct. Such action may include suspension or termination of your account (see Section 14), voiding of any pending rewards, and, if necessary, legal action. We also reserve the right to cooperate with law enforcement and/or affected third parties (such as merchants or networks) in investigating any illegal or prohibited conduct.

7. Cash Back Program Terms

The following terms explain how the MarketRebate cashback program works, including how to earn cashback rewards and the conditions and limitations of the program:
Qualifying Purchases: To earn cashback (rebates) on your trades with MarketRebate, you must conduct your trading through accounts linked via the MarketRebate platform. In practice, this means opening a new trading account using the referral link provided on the MarketRebate website or attaching an existing account to the MarketRebate affiliate group by following the instructions on the broker’s page. By signing up through our platform, the broker will pay back a portion of its spread or commission for each trade you make as a reward for attracting a client, and we pass most of this rebate on to you. This process ensures that your transactions are tracked and eligible for cashback rewards. If you do not use MarketRebate’s link or fail to link your account through our platform, we will not be able to track your trades and will not receive any commission from the broker to share with you – meaning you will not earn any cashback on those transactions. Always double-check that you are logged in to your MarketRebate account and that you’ve followed the proper steps on our site when opening or linking a broker account. Only trades made through correctly linked MarketRebate accounts qualify for rebates, so following the official process is essential to receive your rewards.

Tracking and Cookies: Earning cashback relies on tracking technologies (such as cookies or unique links) to inform the merchant and us that you came from MarketRebate. You may need to disable ad-blockers or ensure your browser accepts cookies from our Site and partner sites so that tracking works correctly. If tracking is blocked or cookies are cleared before the purchase is completed, the transaction might not be attributed to MarketRebate, and cashback will not be awarded. We endeavor to warn or remind you if our system detects that tracking may be inhibited, but we cannot guarantee every scenario, so please check your settings.

Exclusions and Conditions: Not every transaction may qualify for cashback. Each merchant or offer may have specific terms or exclusions. Common examples of exclusions include: certain product categories (e.g., gift cards) might not earn cashback; using coupon codes or discounts not provided by MarketRebate could void cashback for a purchase; gift certificate or store credit purchases may be excluded; and taxes, shipping fees, or other service fees are generally not eligible for cashback. Additionally, if you return, cancel, or modify an order, the cashback for that purchase will typically be canceled or adjusted accordingly. We strongly encourage you to review any “Cashback Terms” or notes listed on the offer page for a given merchant on our Site, as those will highlight important conditions or exclusions for earning cashback at that merchant.

Pending and Confirmed Rewards: After you successfully complete a qualifying purchase through MarketRebate, the cashback reward will initially appear in your account in a pending status (often labeled “Pending” or “Pending Rewards”). Pending rewards mean we have recorded your transaction and are awaiting confirmation from the merchant or affiliate network. Most transactions remain pending until the merchant’s return/exchange period has passed and the merchant confirms the sale and releases the commission to us. The timeframe for confirmation varies by merchant, but it typically takes around 30 to 90 days (some may take longer, especially for travel or high-value services). Once the merchant confirms the transaction and pays the commission, the cashback will move to a confirmed or “payable” status in your account balance. Only confirmed/payable cashback is available for withdrawal (see Section 8).

Cashback Rates and Changes: MarketRebate displays an advertised cashback rate or reward amount for each merchant or offer. We strive to ensure these rates are accurate and up-to-date. However, all cashback rates are subject to change at any time without prior notice, and they are ultimately determined by the commission we receive from the merchant. In some cases, a merchant may change their commission rate or structure (either increasing or decreasing it) before your transaction is confirmed. If such changes occur, the actual cashback you earn might be higher or lower than the rate that was advertised when you clicked through. We will credit you the actual amount we receive for your transaction (minus any portion of commission that we retain, if applicable), which may differ from the expected amount. We do not guarantee any exact amount of cashback until it is credited as confirmed in your account.

Missing Cashback: If you believe you made a qualifying purchase following all required steps but do not see any record of your cashback in your account after a reasonable time (typically, transactions should appear as pending within a few hours to a couple of days), you may need to file a “Missing Cashback” inquiry. Please contact us or use any provided form on the Site to report missing cashback, typically within 30-60 days of the transaction. We will attempt to investigate with the merchant or network. While we will make reasonable efforts to recover the commission for you, please note that we cannot guarantee a positive outcome. If the merchant or tracking network denies the claim (for example, if their records don’t attribute the sale to us, or if you violated their terms), we may not be able to credit you the cashback.

No Cashback on Canceled Orders: If you cancel, return, or refund a purchase, or if a merchant reverses the transaction for any reason, you will not earn cashback for that transaction. If cashback was already credited and the transaction is later reversed or found invalid, MarketRebate reserves the right to adjust your account and deduct the credited amount (even if that results in a negative balance). We appreciate your honesty in only pursuing cashback on bona fide completed purchases that you intend to keep.

Merchant & Program Changes: The list of merchants and offers on MarketRebate will change over time. Merchants may join or leave our program at any time, and certain offers can be modified or discontinued. MarketRebate is not responsible or liable for changes a merchant makes to its policies, pricing, inventory, or the termination of their partnership with us. If a merchant leaves our program or refuses to pay commissions on certain transactions, your ability to earn or redeem cashback at that merchant may be affected. We will remove or update offers as soon as feasible when we become aware of changes, but there may be instances where a change is not immediately reflected on our Site.

Fraud Prevention: For the protection of our merchants and the integrity of our program, MarketRebate actively monitors transactions for signs of fraud or abuse. If we detect activity that is fraudulent, abusive, or suspicious, we may place your account and associated cashback on hold and request additional information or verification from you. We reserve the right to deny or cancel cashback (and/or terminate accounts) if we believe that a transaction was obtained through fraudulent or unethical means, or if you have otherwise violated our Terms (see Section 6 on prohibited activities). In some cases, we may also be required to share relevant information (such as your user ID, purchase details, or account email) with the merchant or affiliate network for the purpose of resolving tracking disputes or investigating fraud. By using our service, you consent to this sharing of information in fraud investigation scenarios.

In summary, the cashback program allows you to earn money back on your everyday transactions, provided you follow the rules and the purchases are tracked properly. We aim to make this process as seamless as possible, but various factors (technical or policy-related) can affect cashback eligibility. Always check the offer details, follow the recommended steps, and don’t hesitate to reach out to us if something doesn’t seem right with your cashback.

8. Cash Back Payments (Withdrawals)

Once you have accumulated confirmed cashback rewards in your MarketRebate account, you may request a withdrawal of your funds, subject to the following conditions:
Minimum Withdrawal Threshold: To be eligible for a withdrawal, your account must meet the minimum confirmed cashback threshold. The default minimum amount is $10, but this may vary depending on the selected withdrawal method and your country of residence. Specific minimum thresholds will be clearly indicated within your account’s withdrawal section.

Supported Withdrawal Methods: Withdrawals may be made via the following channels, subject to availability in your country: + PayPal (recommended) + Direct Bank Transfer (ACH or SEPA) + E-wallets (e.g., Skrill or similar services) + Gift Cards (for selected partners) + Cryptocurrency (subject to applicable laws and availability). MarketRebate may update or remove withdrawal options at any time. You are responsible for providing accurate payment information. We are not liable for failed transactions due to incorrect or outdated payment details.

Payment Processing Time: Once a withdrawal request is submitted and approved, we will generally process it within 3 to 5 business days. However, processing time may vary based on your selected method, account status, transaction volume, and required verification.

Payout Frequency Limits: To optimize payment processing and reduce abuse, we may limit how often withdrawals can be requested. By default, users may request one payout every 7 calendar days. We reserve the right to adjust this interval and may offer more frequent payouts to verified users.

Currency and Fee: Payouts will be issued in your local currency or in USD, depending on your method and location. MarketRebate does not charge fees for standard withdrawals, but third-party providers (e.g., PayPal, banks, crypto networks) may apply transaction or currency conversion fees. These fees are your responsibility.

Verification Requirements: We may require identity verification prior to processing a withdrawal, especially for large amounts or accounts flagged for suspicious activity. Failure to comply may result in delay, rejection, or cancellation of your request.

Adjustments and Reversal: If a merchant retroactively reverses a transaction or voids commission after a payout has been made, we may deduct the corresponding cashback from your future balance or freeze your account pending resolution. See Section 7 for more details on fraud and merchant reversals.

9. Dormant Accounts

To manage administrative costs and keep our platform efficient, MarketRebate has a policy regarding dormant accounts (accounts that have become inactive):
Definition of Dormancy: If you do not log in to your MarketRebate account or have any earning activity for a prolonged period, we may consider your account dormant. Typically, an account may be deemed dormant if there has been no sign-in, click activity, or new cashback earnings for at least six (6) consecutive months. (Note: We reserve the right to adjust the exact timeframe for dormancy. For example, we may choose a longer period such as 12 months, and we will communicate any such period in our FAQs or on the Site. The 6-month period is a general guideline.)

Communication Prior to Termination: If your account reaches a dormant status, we will try to contact you at the email address on file to remind you that your account is inactive. This email will typically advise you to log in to keep your account active, and it will outline the potential forfeiture of rewards if the account remains inactive. It’s important that you maintain an up-to-date email in your profile so you can receive such notices.

Dormant Account Fee or Forfeiture: MarketRebate does not charge monthly or maintenance fees for having an account. However, if an account remains dormant despite our notice, we reserve the right to close the account and, to the extent permitted by law, forfeit any remaining cashback balance. Essentially, cashback rewards are meant to be used, and if an account is abandoned, any accrued rewards may be reclaimed by us when the account is closed due to inactivity. We will only do this after providing notice as described above and giving a reasonable grace period for you to reactivate your account or withdraw your funds.

Keeping Your Account Active: The simplest way to avoid dormancy is to log in to your account periodically. Even if you have no new purchases, logging in at least once within the dormancy period (e.g., once every few months) is usually sufficient to reset the clock on your account’s activity. Alternatively, making a purchase through MarketRebate or referring a new member (if a referral program exists) that results in cashback will also count as activity. Remember, there is no requirement to constantly shop; we just want to ensure the account hasn’t been abandoned or forgotten.

Reactivation: If your account was closed for dormancy and you later get in touch with us, we may (at our sole discretion) assist in reactivating the account. However, any rewards that were forfeited at the time of closure might not be reinstated, especially if a significant time has passed or if the funds have already been reallocated. We encourage users to respond before an account reaches the closure stage to avoid any loss of earned cashback.

Exceptions: In certain jurisdictions, there are laws governing how unused account balances must be handled (sometimes referred to as unclaimed property or escheatment laws). MarketRebate intends to comply with all such laws. This means if required by applicable law, we will attempt to contact you and/or transfer unclaimed funds to the government authority as dictated by statute, rather than simply forfeiting to ourselves. The specifics of this process depend on your country or state’s regulations. Where laws require a longer dormancy period or specific procedures, those will override our 6-month policy for those regions.

Our goal with the dormant accounts policy is not to take anyone’s money, but rather to minimize the upkeep of accounts that are no longer in use. We’d much prefer you keep using MarketRebate and enjoying the benefits! If you have any questions or believe your account was mistakenly marked dormant, please contact our support team for assistance.

10. Modifications to Terms

MarketRebate may revise or update these Terms of Use from time to time. Because laws, technology, and our business can evolve, it may be necessary to make changes to the Terms, and we want to keep you informed of those changes:
Right to Modify: We reserve the right, at our sole discretion, to modify, amend, or replace any part of these Terms at any time. This includes making changes to policies referenced in these Terms or introducing new terms, conditions, fees (if any), or other provisions.

Notification of Changes: If we make material changes to the Terms, we will provide notice to you by posting the updated Terms on our Site with a new “Last Updated” date (and/or via an email to the address associated with your account, or by an in-account notification). What constitutes a “material change” will be determined by us in good faith and common sense, but typically it could be changes that affect your rights or obligations (such as significant changes to payment procedures, dispute resolution terms, etc.). Minor adjustments (like clarifications or grammatical fixes) may not be specifically communicated, so we encourage you to review the Terms periodically.

Acceptance of Changes: Any changes to these Terms will become effective as of the “Last Updated” date posted. By continuing to use the Site or services after we have posted updated Terms (and after any stated effective date, if different), you are indicating that you agree to be bound by the revised Terms. If you do not agree to the changes, you must stop using our Site and services and, if the changes are unacceptable to you, you should terminate your account. Keep in mind that no unilateral amendment will retroactively change dispute resolution provisions for ongoing disputes unless you expressly agree to that change.

Reviewing Updates: We will make the latest version of the Terms available on the Site, and we encourage you to print or save a copy for your records. If you have any questions about any change, feel free to reach out to us for clarification. Sometimes we may also publish a summary of key changes for convenience, but the full Terms as written govern.

Emergency Changes: In some cases, we may need to immediately change the Terms for legal reasons (for example, to comply with a new law or regulation) or to address an urgent situation (such as preventing abuse). We may not be able to give advance notice in such cases, but we will still post the updated Terms and note the effective date.

In summary, as our service grows and changes, these Terms may also change. We will do our best to notify you of significant updates, and your continued use of MarketRebate signifies your acceptance of those updates.

11. Privacy Policy

Your privacy is important to us. Our practices concerning the collection, use, and disclosure of user information are described in our Privacy Policy, which is hereby incorporated into these Terms by reference. By using MarketRebate.org, you acknowledge that you have read and understood the Privacy Policy and agree to MarketRebate’s data practices, including the use of cookies and similar technologies as described therein.

Key points include (for convenience only; the Privacy Policy governs in case of any discrepancy): we collect information that you provide to us (such as account details and transaction data), information from your interactions with the Site (such as clicks and purchases for tracking cashback), and may share certain information with third parties like merchants (for example, to verify transactions for cashback or to provide customer support). We implement security measures to protect your data and offer you choices about your personal information.

If you do not agree with how we handle your data as outlined in the Privacy Policy, please do not use the Site. If you have questions about our privacy practices, you can contact us using the information provided in the Privacy Policy or on the Site. Remember, acceptance of these Terms includes acceptance of our Privacy Policy.

12. Intellectual Property

All content and materials available on MarketRebate.org, including but not limited to text, graphics, logos, button icons, images, audio clips, videos, software, and compilations (collectively, the “Content”), are the property of MarketRebate and/or its licensors or content suppliers, and are protected by applicable intellectual property laws (such as copyright, trademark, and patent laws). The arrangement and compilation of all Content on the Site are the exclusive property of MarketRebate, with all rights reserved.
MarketRebate Trademarks: The trademarks, service marks, logos, and brand names “MarketRebate” and any other trademarks displayed on our Site (collectively, the “Marks”) are the registered or unregistered trademarks of MarketRebate and/or our partners or licensors. You may not use any MarketRebate Marks without our prior written consent. This includes using our logo or any MarketRebate brand or name in metatags, search keywords, or hidden text. All other product and company names mentioned on the Site may be trademarks of their respective owners and are used on the Site for identification purposes only.

Personal Use License: MarketRebate grants you a limited, revocable, non-exclusive, non-transferable license to access and make personal, non-commercial use of our Site and the Content. Under this license, you may view, download (temporary page cache only), and print portions of the Site Content for your personal use in using the cashback services. However, this license does not allow you to:

Modify or Copy: You must not copy, reproduce, distribute, republish, publicly display, or create derivative works from any part of the Site or Content without express permission. This includes scraping or downloading content (other than page caching) for use elsewhere.

Commercial Use: You must not use the Site or any Content for any commercial purpose (other than for its intended shopping and cashback aggregation purpose for your personal savings). For instance, you cannot use our site’s content on your own site or service, nor present it in a framed environment, without our permission.

Reverse Engineering: You must not reverse engineer or extract the source code of our software, nor use any automated means to access or collect data from the Site (except as may be permitted by law for interoperability purposes after giving us prior notice).

All Rights Reserved: Any use of the Site or Content that is not expressly allowed by these Terms is prohibited and will automatically terminate the license granted herein. Such unauthorized use may also violate applicable laws (including copyright and trademark laws) and could result in civil or criminal penalties. User Feedback: If you provide feedback, suggestions, or ideas to MarketRebate (for example, ideas to improve our services or new features), you agree that such feedback is given voluntarily and we are free to use it however we see fit, without any obligation to you. We appreciate and welcome user feedback, but please understand that we may use your suggestions without compensating you, and we are not obligated to keep them confidential. Do not send us any ideas or materials that you consider proprietary; by sending feedback, you grant MarketRebate a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate it into our products and services.

Copyright Infringement Policy: MarketRebate respects the intellectual property rights of others and expects our users to do the same. If you believe that any Content on our Site infringes your copyright or other IP rights, please notify us in writing with detailed information (including identification of the work claimed to be infringed and the location of the material on our Site). Upon receiving a proper notice, we will investigate and, if appropriate, promptly remove or disable access to the allegedly infringing material. Repeat infringers’ accounts may be terminated. (If applicable law like the DMCA in the U.S. applies, we will follow those procedures.)

By using MarketRebate, you agree to respect our intellectual property and that of others. Any unauthorized use of Content may result in termination of your account (see Section 14) and potential legal consequences.

13. Third-Party Sites and Offers

MarketRebate’s platform is built on partnerships and integrations with third parties, including retailers, service providers, and affiliate networks. It’s important to understand our relationship to these third parties and the limits of our responsibility:
Not an E-Commerce Vendor: MarketRebate is not a seller or retailer. When you click through our Site to make a purchase, you are doing so on the third-party merchant’s website, not on MarketRebate. Any purchase, order, or contract for the sale of goods or services is solely between you and the merchant. We do not have control over, or liability for, the quality, safety, legality, or fulfillment of the products or services you purchase from those third-party sites. For example, if you sign up for a trading account through MarketRebate with a listed forex broker, any issues related to your trading activity - such as spreads, execution delays, account restrictions, withdrawal problems, or disputes about bonus terms - must be addressed directly with the broker. MarketRebate is not responsible for the brokerage’s services, nor are we a party to your agreement with them.

Third-Party Terms: Each merchant or partner you interact with through our Site will have its own terms of use, privacy policy, return policy, and so forth. It’s your responsibility to review and understand the terms and policies of any third-party sites you transact with. Our Terms and Privacy Policy govern your use of MarketRebate, but the merchant’s terms govern your purchase from the merchant. MarketRebate does not override or influence the merchant’s own terms.

Links to External Sites: Our Site contains links to external websites or may refer you to external mobile apps (collectively “External Sites”). These links are provided for your convenience or to enable the cashback tracking. MarketRebate is not responsible for and does not endorse the content on any External Sites. We cannot guarantee that any links to External Sites will remain current or accurate. When you click an external link, you will be subject to that site’s terms and privacy practices. If you encounter a broken link or content on an External Site that you believe is inappropriate or outdated, please let us know, but understand that we are not liable for any issues or content on external platforms.

No Endorsement of Third-Party Content: MarketRebate may display third-party content such as product information, coupons, deals, reviews, or advertisements. This content is often provided by the merchant or through affiliate networks and is for informational purposes. While we strive to present accurate information, MarketRebate does not guarantee or warrant that any third-party content (including prices, product descriptions, availability, or coupon validity) is accurate, complete, or up-to-date. Inclusion of such content or the merchants’ logos/brands on our Site does not imply our endorsement of the third party, their site, or their products. It’s your responsibility to verify important details before making a purchase decision.

Interactions with Advertisers and Sponsors: If you participate in promotions, sweepstakes, or other offers from third-party advertisers or sponsors through MarketRebate, any such interaction is solely between you and the advertiser/sponsor. MarketRebate is not responsible or liable for any loss or damage of any sort incurred as a result of any such dealings or as a result of the presence of those third parties on our Site. For example, if you sign up for a credit card offer or a special promotion advertised on MarketRebate, ensure you read the official rules or terms of that offer. We do not assume liability for the outcome of those third-party promotions.

Third-Party Partner Changes: Occasionally, our relationships with merchants or partners may change (e.g., a retailer may leave our program or an affiliate network agreement may end). If a partner’s status changes, certain services we provide related to that partner (such as tracking your cashback or supporting inquiries for that merchant) may be affected. We will make best efforts to update the Site to reflect any removal of a merchant or changes in offers. However, if a partner ceases to honor cashback or goes out of business, MarketRebate cannot fulfill cashback for that merchant from our own funds. We will notify affected users in such cases, but we cannot assume responsibility for a merchant’s failure to pay commissions or honor transactions.

Your Release of MarketRebate: In consideration for being allowed to use our service and benefit from the cashback program, you agree that you will not hold MarketRebate liable for the actions, errors, or omissions of any third-party merchant or service provider. This means, for example, if you have a dispute with a merchant regarding a purchase (faulty goods, refusal to issue a refund, etc.), you release MarketRebate from claims, demands, and damages of every kind and nature arising out of or in any way connected with such dispute. That said, we do care about your experience; while we are not responsible for third-party issues, we welcome feedback and will consider removing or flagging merchants that consistently provide poor customer experience. But any remedy you seek for product or service issues is with the merchant, not with MarketRebate.

In summary, think of MarketRebate as your savvy shopping companion – we help you get money back, but we are not the store you’re buying from. We connect you to many other companies, but we can’t control them. Please shop wisely and understand our role as an intermediary facilitating rewards, not as a direct seller.

14. Termination of Account

Both you and MarketRebate have the right to terminate this agreement (and your account) under certain circumstances as outlined below:
Your Right to Terminate: You may choose to cancel your MarketRebate membership at any time for any reason. If you decide to do so, you should contact us (for example, via a support email or a contact form on the Site) requesting account closure, or use any self-service account deletion function if available in your account settings. Upon verifying your identity and your intent to close the account, we will proceed with termination. We recommend that before you cancel, you withdraw any available cashback balance in your account, because after termination you may no longer have access to the account to request payouts. If you terminate your account (and it was in good standing, without violations), any remaining confirmed cashback that was not yet paid out may be forfeited if you did not withdraw it prior to closing. (If the amount is above a certain threshold, you may contact us to see if an exception can be made to pay it out post-termination, but we are not obligated to do so.)

Our Right to Terminate or Suspend: (a) Without Cause: MarketRebate reserves the right to suspend or terminate your account, or your access to certain features of the service, at any time for any reason or no reason, with or without notice. We might do this as part of a general shutdown of our service, if we discontinue the cashback program, or for any business reason. If we terminate your account without cause (meaning not due to your misconduct), we will generally either allow you to withdraw any remaining confirmed cashback, or we will issue payment to you for any confirmed balance as of termination (assuming we have your valid payment details). (b) With Cause (Violation of Terms): If we have reason to believe you have violated these Terms of Use, engaged in fraud, abuse, or any prohibited activities, or if you otherwise have materially breached your obligations to MarketRebate, we may suspend your account immediately and/or terminate it permanently. In such cases, any pending or confirmed cashback rewards in your account may be voided or forfeited at our sole discretion. For example, if we determine that you obtained rewards through deceptive means or by violating a merchant’s terms, we will cancel those rewards and possibly all rewards in your account. We are not liable to you for the value of rewards forfeited under these circumstances, as those funds are considered void due to violation.

Effect of Termination: Upon termination of your account, your right to use the MarketRebate Site and services will cease immediately. You should understand that any data associated with your account (purchase history, referral info, etc.) may be deleted or no longer accessible to you. We may maintain certain records as required for legal compliance or our internal purposes, but you will not have access to your account once it’s closed. If your account is terminated (by you or us), you are not allowed to create a new account without our express permission. MarketRebate also reserves the right to refuse service or membership to you in the future if an account of yours has been terminated for cause.

Appeal or Reinstatement: If we terminate your account for a perceived violation and you believe we made an error, you may contact our customer service to request a review or appeal. We may (but are not obligated to) provide an opportunity for you to explain your actions and we’ll consider reinstating your account if we find compelling evidence or a misunderstanding. However, the final decision will lie with MarketRebate’s management, and we are under no obligation to reinstate accounts or recover forfeited rewards once a determination has been made.

Surviving Provisions: Even after your account is terminated, certain sections of these Terms will continue to remain in effect with respect to your past use of the Site. Provisions that by their nature should survive termination (such as limitations of liability, governing law, arbitration or dispute clauses (if any), and intellectual property protections) will survive. Termination does not relieve you of any obligations to pay any fees (not applicable currently, as our membership is free) or settled amounts owed to us, nor will it nullify any indemnifications you provided to us.

Account termination is a serious step, but sometimes necessary to protect ourselves and our community. We value our members and will generally only terminate if needed – for example, to combat fraud or if a user requests it. Please ensure you use the service in good faith to avoid any issues leading to termination.

15. Disclaimer of Warranties

MarketRebate.org and all services and content provided through it are offered on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties of any kind, express or implied, about the Site or its services, or any content or materials made available through MarketRebate. To the fullest extent permitted by applicable law, we disclaim all warranties, express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. Without limiting the generality of the above, we specifically do not warrant or guarantee:
Accuracy of Information: That the information on our Site (including cashback rates, product details, prices, and merchant information) is accurate, complete, or up-to-date. We strive for accuracy but cannot guarantee that errors or omissions will not occur, especially when we rely on third parties for data. You acknowledge that offers and content on the Site may include inaccuracies or typographical errors, and you should independently verify information that is important to you.

Availability and Reliability: That the MarketRebate website will be available at any particular time or location, or that it will be uninterrupted, secure, or free of errors, defects, viruses, or other harmful components. While we employ reasonable technical and organizational measures to provide a stable service, we do not guarantee continuous or error-free operation. Routine maintenance, updates, or technical issues may result in temporary service interruptions. You accept that access to the Site may be limited or unavailable during periods of high demand, system upgrades, or for reasons beyond our control (e.g., outages on the Internet or at our hosting provider).

Results of Use: That any results (such as earning a certain amount of cashback or obtaining any particular savings) that may be obtained from the use of the Site will be effective, reliable, or meet your expectations. For example, we do not warrant that you will receive cashback on every intended transaction; sometimes tracking issues or exclusions may prevent it. Any advice or information (oral or written) obtained by you from MarketRebate or through the service does not create any warranty not expressly stated in these Terms.

Third-Party Offerings: We make no warranty on behalf of third-party merchants, partners, or their products/services. Any warranties for products you purchase (such as manufacturer warranties) are between you and the product manufacturer or merchant. MarketRebate is not liable for product defects, recalls, or misrepresentations by the seller. Similarly, if you install a browser extension or mobile app of ours, we do not warrant it will perform without bugs on all platforms or be compatible with all other software on your device.

Security: While we aim to follow best practices for security, we do not guarantee that the Site will be immune from unauthorized access, nor that the security measures in place will never be breached. Any data transmitted to or from the Site is at your own risk. You should use appropriate discretion, up-to-date antivirus, and security tools when downloading any content or interacting online.

No Duty to Update: We undertake no obligation to update or correct information on the Site, except as required by law. It is possible that information becomes stale or out-of-date; we do not guarantee to refresh content immediately or on any set schedule.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of implied warranties. If these laws apply to you, some or all of the above disclaimers may not apply to you to their full extent, and you may have additional rights. In such cases, the scope and duration of any such warranty will be the minimum permitted under applicable law.

In summary, you use MarketRebate at your own risk. We provide a platform to help you save money, but we cannot promise perfection. Always exercise sound judgment, double-check deals, and understand that our service is provided without warranties of any kind.

16. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MarketRebate (including its parent company, affiliates, officers, directors, employees, or agents) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever. This exclusion applies regardless of the theory of liability (contract, warranty, tort (including negligence), strict liability, or any other legal theory) and even if we have been advised of the possibility of such damages. This means that, for example, we are not liable to you for any of the following types of losses or damages that may arise out of or in connection with your use of (or inability to use) MarketRebate or the performance of the services:
Loss of profits or earnings: (whether actual or anticipated, including loss of cashback that you expected to earn, or loss of business opportunities, or any benefits you might have gained from using the saved money elsewhere).

Loss of data or loss of business: (for instance, if there’s a site outage and you miss a deal or if a technical issue deletes information in your account, or any corruption of files or data inaccuracies).

Damage to reputation or goodwill: (such as if a glitch causes an incorrect account action that you feel injures your standing).

The cost of procurement of substitute services: (if our service is unavailable or not performing, any cost you incur to achieve the same purpose through other means).

Personal injuries or property damage: to the extent such damage is not directly caused by our gross negligence or intentional misconduct; however, since we are an online service, physical injuries or property damage are unlikely to arise directly from our platform.

Any other indirect or consequential loss: that was not reasonably foreseeable to us at the time you entered into this agreement.

In addition to the above, and to the extent not prohibited by law, the total aggregate liability of MarketRebate to you for all claims arising out of or relating to these Terms or your use of the Site or services will not exceed the greater of: 1. The total amount of cashback fees or rewards actually paid to you by MarketRebate in the twelve (12) months immediately preceding the event giving rise to the claim, or 2. One hundred U.S. Dollars (USD $100) (or equivalent in local currency).

For clarity, if, for example, you have a dispute and you have only earned $50 in cashback in the last year, our maximum liability to you for any claims would be $100 under the above clause. If you earned $2000 in cashback in that period, our maximum liability would be $2000 (the greater of $100 or what was paid, which is $2000). We set these limits given that our service is provided at no cost to you and the benefits you receive (cashback) are from third-party transactions.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some of the above limitations may not apply to you. In those cases, MarketRebate’s liability will be limited to the fullest extent permitted by the law of your jurisdiction. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law (for example, certain liabilities under product liability law, or for gross negligence, willful misconduct, or personal injury caused by our actions).

Release: You hereby release MarketRebate and its affiliates, officers, and employees from any and all obligations, liabilities, and claims in excess of the limitations set forth above. The limitations of liability in this Section (and elsewhere in these Terms) are a fundamental part of the bargain between you and us and shall apply to all claims of liability (e.g., they are intended to apply even if a remedy fails of its essential purpose).

17. Governing Law and Dispute Resolution

These Terms of Use and any dispute or claim arising out of or relating to them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of [Insert applicable jurisdiction], without regard to its conflict of law principles. The choice of law is made to ensure a consistent legal framework, but we recognize that you may have mandatory consumer protection rights under your local law; these Terms are not intended to override those rights where they apply.
Jurisdiction and Venue: You agree that any disputes or claims arising out of or in connection with these Terms or your use of the Site that cannot be resolved through our customer support or informal negotiation shall be brought exclusively in the courts of St. Vincent and the Grenadines. You and MarketRebate consent to the personal jurisdiction of such courts and waive any objections (such as inconvenient forum) to the handling of the dispute in those courts. The governing law for these Terms shall be the laws of St. Vincent and the Grenadines, without regard to its conflict of law principles.

Injunctive Relief: Notwithstanding the above, you agree that certain breaches of these Terms (such as unauthorized use of our intellectual property) may cause irreparable harm to MarketRebate for which monetary damages would not be an adequate remedy. In such cases, we may seek injunctive relief or other appropriate relief in any competent court, and this will not be deemed incompatible with the agreement to jurisdiction above.

Good Faith Resolution: We sincerely hope to never have a dispute escalate to formal proceedings. If you have any grievances or disputes with MarketRebate, we encourage you to reach out to our support team first and we will attempt to resolve the issue in good faith. Often, misunderstandings or issues can be resolved quickly through communication.

Special Jurisdictional Rights: If you are a consumer residing in a country that provides for specific dispute resolution rights or forums (for example, member states of the European Union providing for local jurisdiction, or states with specific consumer protection boards), this section is not intended to limit any rights you have to initiate a claim in those venues under mandatory local law. You may have additional rights or choices in how disputes are resolved (including potentially arbitration or small-claims court options); these Terms do not waive any of your rights that cannot be lawfully waived.

Use is Unauthorized in Certain Jurisdictions: Use of the MarketRebate Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms. This means if any aspect of these Terms (such as the provisions relating to governing law, liability limitations, or dispute resolution) are not enforceable in the jurisdiction where you are located, we advise you not to use the Site. By using the Site, you affirm that these Terms are enforceable in your locale. If any law or regulation in your area makes these Terms (or part of them) illegal, you should discontinue use of MarketRebate. We make no representation that the services are appropriate or available in any particular location.

18. Miscellaneous Provisions

Entire Agreement: These Terms of Use (along with the Privacy Policy and any additional terms incorporated by reference) constitute the entire agreement between you and MarketRebate regarding your use of the Site and services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us regarding the subject of these Terms. Any prior versions of terms or any communications from us that are inconsistent with the current Terms are of no effect. You acknowledge that you have not relied on any representation, promise, or statement not expressly set out in these Terms in entering into this agreement.

Amendment and Waiver: Except as stated in Section 10 (Modifications), no amendment or modification of these Terms by you is valid unless agreed in writing by an authorized representative of MarketRebate. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Similarly, a waiver by MarketRebate of any breach or default by you on one occasion shall not constitute a waiver of any subsequent or similar breach. Any waiver must be expressly made in writing to be effective, and shall apply only to the specific instance described.

Severability: If any provision of these Terms is found by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. In other words, the invalid part will be deemed modified to the narrowest extent necessary to make it enforceable (or, if that’s not possible, severed entirely), and the rest of the agreement will not be affected or invalidated. The parties also agree to replace any void or unenforceable provision with a valid and enforceable provision that comes closest to the intention underlying the void/unforceable provision.

Assignment: You may not assign or transfer any rights or obligations under these Terms without the prior written consent of MarketRebate. Any attempted assignment by you in violation of this provision is null and void. MarketRebate, on the other hand, may assign or transfer its rights and obligations under these Terms freely to an affiliate, a successor in interest (for example, if we are acquired or merge with another company), or any other party at our discretion. These Terms will inure to the benefit of and be binding upon each party’s permitted successors and assigns.

Relationship of Parties: Nothing in these Terms shall be construed to create any joint venture, partnership, employment, or agency relationship between you and MarketRebate. Neither party has authority to act as an agent or legal representative of the other. You are using the Site as an independent individual (or entity) for your own benefit, and no MarketRebate endorsement or responsibility is implied by any user content or activities.

Headings and Interpretation: The section titles and headings in these Terms are for convenience only and have no legal or contractual effect. Words like “including” shall be interpreted to mean “including without limitation.” In case of any ambiguity in these Terms, they shall not be interpreted in favor of or against one party on the basis of authorship (each party had opportunity to review and negotiate, thus no strict construction against drafter).

Notices: MarketRebate may provide notices to you under these Terms by email to the address associated with your account, by a written notice displayed on your account dashboard or the Site, or by conventional mail. Notices will be deemed given (a) in the case of email, when the email is sent (though if we receive notification that an email was not delivered, we may attempt notice via other means); (b) in the case of posting on the Site, upon posting; and (c) in the case of postal mail, upon delivery. You may contact us as described in the “Contact Us” section of our Site or via any official communication channels we provide. If you need to give us formal notice of a legal issue, you should send it by registered mail or courier to our physical business address (if provided on the Site or in the Privacy Policy) with a copy via email to our support, noting it is a legal notice.

Force Majeure: MarketRebate will not be liable for any delay or failure to perform as required by these Terms because of any cause or condition beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, government action, labor conditions, power failures, internet or telecommunication outages, or other events of force majeure. If such events cause us to delay or omit performance, we will do what we can to resume service as soon as practicable.

Language: These Terms may be translated into other languages for your convenience, but the authoritative version of these Terms is in English (unless we indicate another language is official). In case of any inconsistencies between the English version and a translated version, the English version will control.
